  If you are a commercial operator your O Licence needs protection. There are various defences actually provided by the complicated rules imposing the duties in relation to installing, maintaining, and using Tachographs.

The rules for driver’s hours and conditions of work and keeping records are very complicated. Their application requires a staged process of elimination to determine whether an infringement has taken place.

Firstly, is the vehicle subject to Part VI of The Road Traffic Act 1968? If so, the particular classification of the journey or work must be ascertained. This classification is as follows:

a) international journeys or work
b) national journeys or work
c) domestic journeys or work
d) “Mixed” journeys between (a)-(c).

Then it is necessary to determine whether the vehicle is a goods or passenger vehicle. Lastly it will be necessary to think about any exemptions.
